Terms of Use
1. Accepting these Terms
These Terms of Use (the “Terms”) govern access to and use of EyesPie, including the website, authentication flows, private hunts, challenges, photo evidence, leaderboards, peer voting, shared albums, wager-mode payments, prize calculations, payout features, and related services (collectively, the “Service”).
By creating an account, signing in, joining or hosting a hunt, submitting a photo, voting in a matchup, paying an entry, accepting a prize, or otherwise using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.
If you join a hunt created by another person, that host may establish additional hunt-specific rules that do not conflict with these Terms. Where a hunt-specific rule conflicts with these Terms, these Terms control.
2. Definitions
- “Host” means the user who creates or administers a hunt.
- “Player” or “Participant” means a person who joins a hunt.
- “Challenge” means an item, sighting, task, or prompt that may award points after qualifying photo evidence is submitted.
- “Evidence” means a photo and associated submission information provided to prove completion of a Challenge.
- “Friendly mode” means a hunt that does not require a paid entry and does not award a cash prize through EyesPie.
- “Wager mode” means an eligible paid-entry contest in which prize amounts may be distributed according to the hunt’s locked prize settings, subject to payment-provider and legal availability.
- “Gross entry pool” means the total qualifying entry amounts actually collected for a wager hunt before the EyesPie platform fee and any required adjustments.
- “Final prize pool” means the amount available for prizes after the EyesPie platform fee and any payment reversals, refunds, legally required deductions, or other disclosed adjustments.
3. Eligibility and age requirements
You must be legally capable of entering into these Terms. EyesPie is not designed for children. Wager mode is intended only for adults who meet the minimum legal age and all other eligibility requirements applicable to paid contests where they are physically located and where the hunt is conducted.
You are responsible for determining whether your participation is lawful. A feature being visible in the app does not mean it is legal or available in every jurisdiction. EyesPie may restrict, suspend, or disable wager features by location, account, payment provider, or other compliance criteria.
If a hunt involves alcohol, casinos, nightlife, age-restricted venues, travel, or similar activities, participants must independently satisfy the age, identification, admission, and conduct requirements imposed by those venues and applicable law.
4. Accounts, authentication, and account security
You must provide accurate information and keep your sign-in credentials and verification codes secure. You are responsible for activity conducted through your account unless applicable law provides otherwise. Do not sell, rent, transfer, or share an account in a way that misrepresents who completed a Challenge or who is entitled to a prize.
EyesPie may use Google, email/password, phone verification, Firebase Authentication, or other supported identity methods. Authentication by a third party does not make that third party responsible for the Service.
If you believe your account or hunt has been accessed without authorization, stop using the affected account and contact support as soon as a support channel is available.
5. What EyesPie does
EyesPie is a private photo scavenger-hunt platform. Hosts can create hunts, invite participants, select a game mode, and start or end play. Players can view Challenges, submit Evidence, earn points after qualifying submissions are processed, view live standings, and access accepted photos through the shared album after the hunt ends.
EyesPie may also provide peer-photo matchups, trip-story features, notifications, prize previews, payment status, and other game tools. Peer voting is a scoring feature: every completed vote adds 3 points to the voter and 3 points to the owner of the selected photo. Other supplemental features do not change the official score unless the Service expressly says they do.
6. Friendly mode and wager mode
Friendly mode
Friendly mode is played for points, bragging rights, or prizes arranged separately by the group. EyesPie does not represent that any separately arranged prize is funded, insured, guaranteed, or administered by EyesPie.
Wager mode
Wager mode, when enabled and approved for the relevant account and transaction flow, requires a qualifying paid entry and uses the prize rules shown before payment and before the hunt begins. Wager mode may be unavailable even if friendly mode remains available.
7. Host responsibilities
Hosts have elevated control over a private hunt and must use that control responsibly. A Host must:
- communicate the game mode, entry amount, prize structure, timing, and any group-specific rules accurately;
- avoid creating Challenges that encourage illegal, dangerous, invasive, humiliating, discriminatory, sexually exploitative, or non-consensual conduct;
- review Evidence in good faith and not selectively reject valid submissions simply to manipulate standings;
- avoid changing material conditions after participants have reasonably relied on them;
- not represent that a payout is guaranteed before the underlying payment has cleared and final standings are locked; and
- cooperate with reasonable fraud, payment, safety, or compliance reviews.
EyesPie may preserve server-side records of scoring, payment, and submission states even when a Host has moderation powers in the interface.
8. Player responsibilities
Players must submit their own qualifying Evidence, follow the applicable hunt rules, and use the Service without interfering with other participants, venues, employees, bystanders, or systems. You must not impersonate another player, submit another person’s Evidence as your own, manipulate metadata or account states to obtain points, or coordinate fraudulent payments or disputes.
Participation is voluntary. If you are uncomfortable with a Challenge, skip it. No Host or other Player is authorized by EyesPie to pressure you into unsafe, illegal, invasive, or non-consensual activity.
9. Photo evidence, scoring, and moderation
EyesPie is designed so that a Challenge is not manually checked off without Evidence. A submission may pass through upload, pending, accepted, invalidated, replaced, or other processing states. Points are intended to be awarded by server-side logic using the Challenge value stored for the hunt rather than a score supplied by the player’s browser.
Peer-photo voting also contributes to the official score. When an eligible player submits a peer vote, the voter receives 3 points and the owner of the selected photo receives 3 points. Those points can affect standings and, in wager mode, final prize placement. Peer votes do not alter the base point value of either Challenge or change the prize-pool formula.
A Host may reject Evidence that does not reasonably prove the Challenge, violates the hunt rules, appears fraudulent, or violates these Terms. If replacement Evidence is permitted, the original player may be able to resubmit without receiving duplicate points.
Technical metadata, timestamps, file information, or automated checks may assist review but are not guaranteed to prove exactly when or where a photo was taken. EyesPie may resolve obvious technical scoring errors, but it is not an independent fact-finding or arbitration service for every disagreement between friends.
10. Your photos and other user content
You retain ownership of content you lawfully own. By uploading Evidence or other content, you grant EyesPie a non-exclusive, worldwide, royalty-free, limited license to host, store, reproduce, transcode, resize, analyze, secure, display, and transmit that content as reasonably necessary to operate and improve the Service, enforce hunt rules, perform host review, provide limited peer-photo matchups, produce the shared album or trip story, investigate abuse, and comply with law.
This license lasts for as long as the content is retained for those purposes and any additional period reasonably required for backups, disputes, fraud prevention, legal obligations, or system integrity. It does not transfer ownership of your photo to EyesPie.
You represent that you have the rights and permissions necessary to upload the content. Do not upload intimate imagery without consent; illegal content; material that exploits minors; content that infringes privacy, publicity, copyright, trademark, or other rights; or content captured through unlawful trespass, harassment, stalking, coercion, or hidden-camera conduct.
If another person is identifiable in a photo, you are responsible for respecting applicable consent, privacy, venue, and recording laws. A scavenger-hunt prompt does not create permission to photograph someone who has asked not to be photographed.
11. Safety and prohibited real-world conduct
EyesPie does not supervise participants in the physical world and cannot verify the safety of every Host-created Challenge. You are responsible for your own conduct, surroundings, travel, alcohol consumption, interactions, and decision-making.
12. Wager-mode availability and legal compliance
Paid-entry games and games of skill with prizes may be regulated or restricted depending on jurisdiction, payment method, age, location, and business model. Wager mode is offered only when EyesPie determines it can make the feature available, and availability may change without affecting friendly-mode access.
EyesPie may require additional identity, age, residency, geolocation, tax, payment, or eligibility information, directly or through a service provider. We may decline or reverse wager participation when reasonably necessary to comply with applicable law, payment-provider requirements, fraud controls, or a governmental or provider request.
13. Entry payments, the 9% platform fee, and the prize pool
In wager mode, the participant is charged the entry amount shown at checkout unless the checkout expressly identifies another charge. Under the current product structure, EyesPie does not add the 9% platform fee on top of that displayed entry amount. Instead, a 9% platform fee is deducted from the qualifying gross entry pool when final prize amounts are calculated.
Normal hunt and checkout screens may present the buy-in and prize pool without separately itemizing the platform fee. At final payout, EyesPie may show the collected pool, platform fee, final prize pool, prize assignments, payment state, and related amounts. Amounts can change if an entry is refunded, reversed, disputed, duplicated, fails to clear, becomes ineligible, or is otherwise adjusted.
Stripe or another processor may charge EyesPie separate payment-processing, payout, currency-conversion, dispute, or network fees. Unless the player checkout clearly states otherwise, those provider costs are not an additional player-facing charge at the moment of entry, but they may affect EyesPie’s economics and the availability of the feature.
14. Prize structures, previews, final standings, and ties
The Host may be able to select among a default smart split, percentage-based prizes, or fixed-dollar prizes before the hunt begins. Prize settings lock when the hunt starts unless EyesPie expressly provides a correction mechanism for an error or legally required adjustment.
For the default smart split currently implemented, wager hunts require at least four qualifying paid players. From the available prize pool, the top three positions are first allocated one entry amount each when the pool supports that structure. The remaining bonus pool is divided 80% to first place and 20% to second place.
For custom prize structures, EyesPie is designed to reject settings that exceed the available prize pool. If a custom configuration uses less than the full available pool, the unused amount becomes an extra first-place bonus rather than being silently retained as unallocated player prize money.
Leaderboard amounts shown during play are previews. Final prizes depend on locked standings, including challenge points and peer-vote points, qualifying payments, final prize settings, and any required adjustments. If participants tie across a prize boundary on the scoring criteria used by the product, EyesPie may pool the affected prize positions and divide the combined amount among the tied players according to the wager rules displayed for that hunt.
15. Winner payouts and Stripe Connect
EyesPie may use Stripe Connect or another approved payout provider to deliver eligible prizes. A potential winner may be required to complete provider-hosted identity, tax, bank, debit-card, or payout onboarding. EyesPie generally receives connected-account identifiers and readiness/status information rather than the full bank-account or card credentials entered into provider-hosted forms.
A final prize may remain pending when onboarding is incomplete, a connected account is restricted, the underlying funds are not yet available, a payment is under review, a dispute exists, or the provider reports another compliance or transfer issue. EyesPie may retry an eligible payout after the blocking condition is resolved.
Bank arrival times are controlled by the payout provider, financial institutions, account configuration, and applicable holds. A prize marked as created or transferred is not a promise of a specific bank-posting time.
16. Refunds, cancellations, chargebacks, and payment disputes
Except where applicable law requires otherwise, an entry is not automatically refundable simply because a participant changes plans, misses Challenges, loses the hunt, is removed for misconduct, fails to finish, or dislikes the final standings. A Host cannot promise a refund on behalf of EyesPie unless the product actually provides for it.
EyesPie may issue, require, or facilitate refunds when a hunt is cancelled before meaningful play, a duplicate or erroneous charge occurs, a payment cannot lawfully be retained, a material technical failure prevents the paid service from being provided, or another circumstance reasonably warrants correction.
A chargeback, dispute, reversal, refund, or failed payment may remove the associated entry from the qualifying pool and can alter prize amounts or pause payouts. Filing a knowingly false payment dispute may result in account restrictions and may be treated as abuse of the Service.
17. Taxes and reporting
Participants and prize recipients are responsible for understanding and satisfying their own tax obligations. EyesPie or its payment provider may collect tax information, withhold amounts, issue forms, or report payments when required by applicable law. Amounts shown in the Service are not tax advice.
18. Fraud, manipulation, and abuse
You may not manipulate scores, duplicate submissions, tamper with payment or payout states, abuse promotional credits, falsify identity, coordinate fake accounts, submit intentionally misleading Evidence, interfere with backend requests, exploit security vulnerabilities, scrape private hunt content, reverse engineer access controls for abuse, or attempt to obtain prizes through deception.
EyesPie may use account records, Evidence metadata, payment-provider signals, server logs, challenge state, and other reasonably available information to investigate suspected abuse. We may invalidate points, remove ineligible payments from prize calculations, pause payouts, restrict accounts, or preserve evidence of suspected fraud.
19. Privacy
Our Privacy Policy explains the categories of information we process, why we process it, who may receive it, how photo evidence and payment/payout data are handled, and the choices available to users. Hunt privacy does not mean that only you can ever see your submitted content: Hosts can review Evidence, limited peer voting may display anonymized accepted images during a hunt, and accepted photos may become visible to the hunt membership after the hunt ends.
20. Third-party services
EyesPie relies on third-party services, which may include Google Firebase / Google Cloud, Stripe, browser and mobile operating-system features, telecommunications networks, app stores, domain/hosting providers, and financial institutions. Your use of third-party services may also be governed by their own terms and privacy practices.
EyesPie is not responsible for a third party’s independent outage, account restriction, payment review, bank delay, device limitation, network failure, or policy decision, although we may take reasonable steps within the Service to recover, retry, or communicate status.
21. EyesPie intellectual property and feedback
Except for user content and third-party materials, the Service, branding, software, interface, graphics, challenge collections, documentation, and related intellectual property are owned by or licensed to the EyesPie service operator and are protected by applicable law. These Terms give you a limited, revocable, non-transferable right to use the Service for its intended purpose; they do not transfer ownership of the Service.
If you voluntarily send ideas, suggestions, bug reports, or product feedback, you permit EyesPie to use that feedback to operate and improve the Service without a payment obligation to you, unless separately agreed in writing.
22. Service availability and changes
The Service may change over time. Features can be added, modified, limited, suspended, or removed. EyesPie depends on internet access, supported browsers, cameras, Firebase, payment providers, and other infrastructure and therefore cannot promise uninterrupted or error-free availability.
We may schedule maintenance, deploy emergency fixes, rate-limit traffic, change storage formats, or temporarily disable a feature to address security, legal, compliance, fraud, financial, or technical concerns.
23. Suspension and termination
EyesPie may restrict or suspend access when we reasonably believe an account or hunt violates these Terms, threatens safety or security, creates legal or payment risk, abuses other people, compromises the integrity of a contest, or interferes with operation of the Service.
Where practical, restrictions affecting legitimate prize claims or stored content will be handled in a manner that preserves records reasonably needed to resolve outstanding payments, disputes, or legal obligations.
24. Disclaimers
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. EyesPie does not warrant that every Challenge is appropriate for every participant or location; that every submission will upload successfully on every device or network; that every participant will behave fairly; that a particular prize or payment feature will remain available; or that the Service will be uninterrupted, error-free, or free from every security vulnerability.
Nothing in the Service is legal, tax, financial, medical, safety, or gambling advice. Participants must use their own judgment and obtain professional advice where appropriate.
25. Limitation of liability
To the maximum extent permitted by applicable law, EyesPie and the Service operator will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for losses arising from participant conduct, physical-world activities, venue actions, lost belongings, travel disruption, unauthorized photography by another user, third-party outages, or loss of anticipated winnings.
Nothing in these Terms excludes liability that cannot legally be excluded or limited. If applicable law requires a remedy that conflicts with a limitation in these Terms, that mandatory law controls.
26. Your responsibility for claims caused by your conduct
To the extent permitted by law, you agree to be responsible for claims, losses, or reasonable costs arising from your unlawful conduct, content you had no right to upload, intentional fraud, infringement of another person’s rights, or material violation of these Terms. This provision does not require a consumer to waive rights or protections that cannot legally be waived.
27. Changes to these Terms
We may update these Terms as the product, law, payment relationships, or business changes. The effective or last-updated date identifies the current version. Material changes may be presented in the Service and may require renewed acceptance before certain actions, especially before making another wager-mode payment.
28. Questions, notices, and legal contact
For hunt-specific questions, contact the Host first. For product or Terms questions, use the support method published by EyesPie. A dedicated legal contact address should be used for formal legal notices once published by the Service operator.
